The United Nations has released its first-ever guidelines on access to social justice for people with disabilities to make it easier for them to access justice systems around the world. What this aims to do is make it easier for disabled people around the world to access justice systems.

‘Ground-breaking guidance’. Those are the words used by the United Nations (UN) to describe the 10 principles or guidelines, its first-ever, that aim to enable people with disabilities around the world to access social justice. What this means is that disabled people can use justice systems around the world as easily as anyone else, in line with international standards.

The guidelines outline a set of 10 principles and detail the steps for implementation. The 10 principles are:

• Principle 1: All persons with disabilities have legal capacity and, therefore, no one shall be denied access to justice on the basis of disability.

• Principle 2: Facilities and services must be universally accessible to ensure equal access to justice without discrimination of persons with disabilities.

• Principle 3: Persons with disabilities, including children with disabilities, have the right to appropriate procedural accommodations.

• Principle 4: Persons with disabilities have the right to access legal notices and information in a timely and accessible manner on an equal basis with others.

• Principle 5: Persons with disabilities are entitled to all substantive and procedural safeguards recognized in international law on an equal basis with others, and States must provide the necessary accommodations to guarantee due process.

• Principle 6: Persons with disabilities have the right to free or affordable legal assistance.

• Principle 7: Persons with disabilities have the right to participate in the administration of justice on an equal basis with others.

• Principle 8: Persons with disabilities have the rights to report complaints and initiate legal proceedings concerning human rights violations and crimes, have their complaints investigated and be afforded effective remedies.

• Principle 9: Effective and robust monitoring mechanisms play a critical role in supporting access to justice for persons with disabilities.

• Principle 10: All those working in the justice system must be provided with awareness-raising and training programmes addressing the rights of persons with disabilities, in particular in the context of access to justice.

මාර්ගෝපදේශ මූලධර්ම 10 කින් සමන්විත වන අතර ක්‍රියාත්මක කිරීම සඳහා වන පියවර විස්තර කරයි. මූලධර්ම 10 නම්:

• 1 වන මූලධර්මය: ආබාධ සහිත සියලු පුද්ගලයින්ට නෛතික හැකියාවක් ඇති අතර, එබැවින්, ආබාධිතභාවය මත කිසිවෙකුට යුක්තිය සඳහා ප්‍රවේශය අහිමි නොවේ.

• 2 වන මූලධර්මය: ආබාධ සහිත පුද්ගලයින් වෙනස් කොට සැලකීමකින් තොරව යුක්තියට සමාන ප්‍රවේශයක් සහතික කිරීම සඳහා පහසුකම් සහ සේවාවන් විශ්වීයව ප්‍රවේශ විය යුතුය.

• 3 වන මූලධර්මය: ආබාධ සහිත දරුවන් ඇතුළු ආබාධ සහිත පුද්ගලයින්ට සුදුසු කාර්ය පටිපාටික නවාතැන් පහසුකම් ඇත.

• 4 වන මූලධර්මය: ආබාධ සහිත පුද්ගලයින්ට නෛතික දැන්වීම් සහ තොරතුරු කාලෝචිත හා ප්‍රවේශ විය හැකි ආකාරයකින් අන් අය සමඟ සමාන පදනමක් මත ලබා ගැනීමේ අයිතිය ඇත.

• 5 වන මූලධර්මය: ආබාධ සහිත පුද්ගලයින්ට ජාත්‍යන්තර නීතියෙන් පිළිගත් සියලු වැදගත් හා කාර්ය පටිපාටික ආරක්ෂණ සඳහා අන් අය සමඟ සමාන පදනමක් මත හිමිකම් ඇති අතර, නියමිත ක්‍රියාවලිය සහතික කිරීම සඳහා අවශ්‍ය නවාතැන් පහසුකම් රාජ්‍යයන් විසින් ලබා දිය යුතුය.

• 6 වන මූලධර්මය: ආබාධ සහිත පුද්ගලයින්ට නොමිලේ හෝ දැරිය හැකි නීති ආධාර ලබා ගැනීමේ අයිතිය ඇත.

• 7 වන මූලධර්මය: ආබාධ සහිත පුද්ගලයින්ට අන් අය සමඟ සමාන පදනමක් මත යුක්තිය පසිඳලීමට සහභාගී වීමේ අයිතිය ඇත.

• 8 වන මූලධර්මය: ආබාධ සහිත පුද්ගලයින්ට පැමිණිලි වාර්තා කිරීමට සහ මානව හිමිකම් උල්ලංඝනය කිරීම් සහ අපරාධ සම්බන්ධයෙන් නීතිමය කටයුතු ආරම්භ කිරීමට, ඔවුන්ගේ පැමිණිලි විමර්ශනය කර ඵලදායී පිළියම් ලබා දීමට අයිතියක් ඇත.

• 9 වන මූලධර්මය: ආබාධ සහිත පුද්ගලයින් සඳහා යුක්තිය ඉටු කර ගැනීම සඳහා ඵලදායී හා ශක්තිමත් අධීක්ෂණ යාන්ත්‍රණ තීරණාත්මක කාර්යභාරයක් ඉටු කරයි.
